General Terms and Conditions, Customer Information and Notes on the Disposal of Batteries




 

§ 1 Scope, subject matter of the contract and identity of the seller




 

(1) The following provisions apply to all contracts between us, namely

as seller, and you as buyer about the sale and delivery of the items offered by us through our online store.



 

§ 2 Consumer and entrepreneur




 

(1) Our offers are directed to both consumers and entrepreneurs.



 

(2) A consumer in this sense is any natural person who enters into a contract with us for purposes that are predominantly neither commercial nor self-employed.



 

(3) An entrepreneur in this sense is a natural or legal person or a partnership with legal capacity who, when concluding the contract with us, acts in the exercise of his commercial or independent professional activity.



 

§ 3 Agreements and information on the conclusion of the contract




 

(1) The individual technical steps leading to the conclusion of the contract, the conclusion of the contract itself and the possibilities of correction are carried out in accordance with the following provisions.



 

(2) The presentation of the articles in our online store does not constitute a legally binding offer, but an invitation to order.



 

(3) You place the items intended for purchase in the shopping cart. You can call up the shopping cart via the corresponding button in the navigation bar and make changes there at any time. After calling up the order form, you enter the personal data and the payment and shipping conditions. Before sending the order, you have the opportunity to check all the information again, change - this also via the "Back" function of your Internet browser - or cancel the purchase. If you have gone through all the steps of the ordering process and then complete it by pressing the button: "Buy", you place a binding order for the items listed on the order page. The contract is concluded depending on the payment method you have chosen (instant bank transfer, PayPal or prepayment) as follows:


In the case of payment by instant transfer, you will be redirected to the website of the provider SOFORT Überweisung after sending the order. If you have entered your data there and confirmed the payment instruction, the contract is concluded.


In case of payment by PayPal, you will be redirected to the website of the provider PayPal when placing the order, where you enter your data and confirm the payment instruction. After sending the order, PayPal will be requested by us to initiate the payment transaction. This is the conclusion of the contract.


In the case of payment in advance, your order will be accepted by us by sending an order confirmation, in which you will be given our bank details, by e-mail. This concludes the contract. The order confirmation will be sent immediately, at the latest within 24 hours after receipt of your order.



 

(4) The processing of the order and transmission of all information required in connection with the conclusion of the contract shall be effected by e-mail. You are therefore obliged to ensure that the e-mail address you have given us is correct and that the receipt of e-mails is technically guaranteed, i.e. in particular that it is not blocked by SPAM filters, for example.



 

§ 4 Storage of the contract text and language of the contract




 

(1) The complete text of the contract will not be stored by us. Before you send the order, you can print out the contract data using the print function of your Internet browser or save it electronically. After we have received your order, the order data, the General Terms and Conditions including the information required by law for distance contracts will be sent to you again by e-mail.



 

(2) The language available for the conclusion of the contract is German.



 

§ 5 Essential characteristics of the goods




 

The essential characteristics of the goods can be found in the item description of the respective offers.



 

§ 6 Prices, shipping costs, return costs in the event of revocation and terms of payment




 

(1) The purchase prices stated on the respective item pages to be paid by you include the statutory value added tax.



 

(2) Shipping costs are additionally incurred for each order. They can be called up via a correspondingly designated button in the respective item description, are shown separately in the course of the ordering process, and are not included in the price.

(3) In the event of revocation, you shall bear the direct costs of returning the goods.



 

(4) The available payment methods are listed in the respective item description.



 

(5) Unless otherwise stated in the individual payment methods, the purchase price to be paid by you is due for payment immediately.



 

(6) Insofar as a purchase on account is made via PayPal, we assign our claim against you in full and irrevocably to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. You agree that PayPal (Europe) S.à r.l. et Cie, S.C.A. may perform a credit check using the submitted data prior to accepting the assignment. We reserve the right to refuse you this payment method as a result of the credit check. You will be informed of this in the checkout process. If the purchase on account via PayPal is allowed, PayPal (Europe) S.à r.l. et Cie, S.C.A. accepts the assignment, so that debt-discharging payments can only be made to PayPal (Europe) S.à r.l. et Cie, S.C.A.. The term of payment is 14 days from receipt of the goods.



 

§ 7 Terms of delivery




 

The terms of delivery, the delivery date and any existing delivery restrictions can be found in the respective item description. As far as in the article description no other period is indicated, the supply of the commodity takes place within two weeks after conclusion of a contract, with agreed upon pre-payment however only after the time of your payment instruction.



 

§ 8 Warranty




 

There are the statutory warranty rights for the goods.



 

§ 9 Dispute Resolution / OS Platform




 

(1) The European Commission offers a platform for out-of-court online dispute resolution (so-called OS platform) for consumers at https://ec.europa.eu/consumers/odr/, to which the consumer can turn in case of disagreements in connection with a purchase or service contract concluded online via electronic commerce.



 

(2) We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.



 

Information on the disposal of batteries




 

We are required by law to inform you of the following in connection with the sale of batteries or the supply of equipment containing batteries:


After use, you can return batteries that we carry or have carried to us free of charge.



 

As the end user, you are legally obligated to return used batteries.



 

The symbols shown on the batteries have the following meaning:


The symbol of the crossed-out garbage can means that the battery must not be disposed of in household waste.



 

Hg = Battery contains more than 0.0005% mercury by mass.


Cd = Battery contains more than 0.002 mass percent of cadmium.


Pb = Battery contains more than 0.004 mass percent lead.
